MEMORANDUM IN SUPPORT

A.8590 / S.5884

On behalf of our 12,000 members, the New York State Chapter of the National Association of Social Workers strongly supports Governor Spitzer’s recent initiative to provide same-sex couples with the opportunity to enter into civil marriages.

The social work profession, in accordance with NASW Code of Ethics, recognizes the equal rights of all people without regard to sexual orientation.  Unfortunately, heretofore, under state law, same sex couples in New York are not afforded equal benefits, rights, or protections granted to heterosexual couples. Despite the fact that same-sex couples live in relationships that are based on basic principles of strong and loving commitment to another, responsibility, and a right to enter into a marriage with their partner of choice, they continue to be denied the human rights, legal and economic stability provided by the recognized institution of marriage.

The denial of such rights and privileges has far reaching and negative impacts on the individual, the couple, and their families. These families are more likely to be denied important legal protections and financial benefits such as: child custody, recognized decision making, family medical leave act, family healthcare coverage, survivor benefits and inheritance.

Discrimination and prejudice directed against any group is damaging to the well being of the affected group and society as a whole; as such we applaud the Governor’s initiative and stand ready to advocate with him for the rights of thousands of New Yorker’s.

NASW-NYS urges members of the New York State Legislature to provide long over-due legal protections to same-sex couples by passing Governor Spitzer’s same-sex marriage initiative.
