An act to amend the penal law and the criminal procedure law, in relation to sentencing for the commission of certain provisions of murder in the first degree.
Synopsis and Provisions:
The proposed legislation seeks to establish the death penalty as a sentence for an individual convicted of intentional murder of a police officer, peace officer or employee of the Department of Correctional Services.
This bill stipulates that the jury will impose sentencing and in the event a jury cannot come to a unanimous decision the convicted individual will be sentenced to life in prison without parole.
Status:
This bill passed the Senate on 5/14/07, was delivered to the Assembly and referred to the Assembly Codes Committee on 5/15/07. This bill died in the Assembly and was returned to the Senate. The bill was referred to the Assembly Codes Committee and the Senate Codes Committee on 1/9/08.
