Governor Signs Corporate Practice and Exemption Bills!!!

checkCorporate Practice of Social Work Issue (Authorized Settings)

checkExtension of the “O” Agency Exemption

As you are aware, NASW NYS and NYC have worked on your behalf, non-stop over the last two years (with a number of partners) to secure passage of legislation to resolve the corporate practice and “O” agency exemption issues related to the practice of social work.  Finally, there is reason to celebrate, as the Governor has signed the legislative measures into law.  Click here for our recent update on the legislation. The State Education Department’s Office of the Professions is working to revise applications and provide answers to questions and will post updates on the web at: www.op.nysed.gov.

With this latest accomplishment we have achieved resolution to a number of your licensing concerns, although there are a number of outstanding issues. We have worked closely with the Office of the Professions on these areas as well. At its June meeting, the Board of Regents approved emergency regulations that will address many of these issues, including:

  • Reducing the number of contact hours required for the LCSW,
  • Providing for the prospective review of acceptable work settings for LMSW’s working toward their LCSW,
  • Reducing the number of required supervisory hours and providing additional flexibility in the delivery of supervision, and
  • Clarifying the definition of acceptable settings.

To review a copy of these emergency regulations, you may log onto: http://www.regents.nysed.gov/meetings/2010Meetings

After the public comment period, the Board of Regents may adopt these changes as permanent, at their September 2010 meeting.

You can be assured that NASW NYS and NYC represent ALL social workers in ALL areas of practice.  Your membership dues have, and will continue to support our legislative efforts on your behalf.  We will continue to communicate with you via our newsletter, email alerts, and website postings to keep you fully informed on any new developments as we move through the implementation process.  NASW is here to support you and your practice.
